13. Dispute Resolution and Arbitration
13.1 Informal Resolution

Costa Vida will attempt to resolve the dispute informally by contacting you via email. If the dispute is not resolved within thirty (30) days of submission, either party may proceed to formal dispute resolution as described below.
13.2 Binding Arbitration
EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ALL DISPUTES ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE WEBSITE SHALL BE RESOLVED THROUGH BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES, WHICH ARE AVAILABLE AT www.adr.org.
The arbitration shall be conducted in English and shall take place in the United States. 13.3 Class Action Waiver

In such circumstances, Costa Vida's performance obligations shall be suspended for the duration of the Force Majeure Event.
